Legal Information

I really like the idea of Sabah so is it possible to get married legally in Sabah?

The wedding couple would need to get in touch with the Malaysian Embassy in their country of origin prior to their arrival in KK. A letter stating their intention to marry and that there is no impediment to marry will be required.

Note

  • The letter can be in a “Statutory Declaration” format or Letter of Single status which states there is no impediment to marry.
  • A certificate of single status from the Registry of Births, Marriages and Deaths would further support the application.
  • If in doubt on format, please send a draft to Wedding Destinations for verification before its sent for endorsement
  • The legal age for marriages in Malaysia is 21 years and above. Those who are below this age will require parental consent. Forms must be signed by a parent, usually the Father and submitted together with the rest of the documents listed. Please inform the Wedding Destinations if this form is required.
  • Please ensure that the period of singleness is up to date, e.g. from December 1980 to date when wedding is to take place or from the time of divorce decreed to date when wedding is to take place.

The Malaysian Embassy will acknowledge the said documents and stamp the letter with the Embassy’s seal. This letter must be brought to KK.
On arrival in KK, both bride & groom will be required to appear personally at the Commissioner of Oath’s office to sign documents and apply for the marriage licence. Transportation charges from the Resort to the Commissioner’s office is chargeable to the couple (RM 400.00nett return transfer). A full set photocopies of the documents for submission and 2 passport-sized photos of the Bride and Groom will be required for the application.
After which, the couple will proceed to the Marriage Registrar’s office to confirm dates for the wedding ceremony and submit application for the ceremony and application for the marriage license. We will assist with the completion of the forms as they are all in Bahasa Malaysia (Malay).

Note

  • Please standby 2 passport – sized photos
  • Full set of endorsed documents to be photocopied ready for the submission
  • Photocopy of entry stamp and immigration card will be photocopied on arrival so that it can be included in bundle of documents for the submission

On the agreed date and time, the Marriage Registrar will meet with the couple at the Resort to solemnise the wedding or couple will return to the Registry for the solemnisation. Transportation charges from the Resort to the Registry will be chargeable (RM 400.00nett return transfer). Service fees are chargeable at RM 400.00nett for solemnisation done at the Resort.

Note

  • Witnesses who are foreigners are also required to have a photocopy of their passport, entry stamp and immigration cards submitted.
  • Proper attire required for the solemnization i.e. no shorts, t-shirts or slippers
